Terms of Service

Welcome to Zhook. By creating an account or using our service, you agree to be bound by these Terms of Service. If you are using Zhook on behalf of a company, you represent that you have the authority to bind that entity to these terms.

1. The Service

Zhook provides an automation and infrastructure layer for MQTT and Webhook routing. We offer various tiers of service, including free and paid subscriptions, which determine your event volume, rate limits, and data retention periods.

2. User Accounts & Seats

Account Security: You are responsible for all activity under your account. You must secure your API keys and credentials.

Organization & Seats: If your plan includes multiple seats, each seat must be assigned to a unique individual. "Seat sharing" to bypass per-user billing is a violation of these terms and may result in account suspension.

3. Acceptable Use Policy

You agree NOT to use Zhook to:

  • Illegal Activities: Transmit any data that is illegal, harmful, or violates third-party rights.
  • System Abuse: Attempt to bypass rate limits, probe our infrastructure for vulnerabilities, or use the service to facilitate DDoS attacks.
  • Sanctioned Regions: Access the service from jurisdictions subject to international sanctions (including Russia, Iran, North Korea, Syria, and Cuba).
  • Malicious Payloads: Route malware, viruses, or any code designed to disrupt or damage systems.

4. Data & Payload Responsibility

User Content: You retain all ownership of the data payloads sent through Zhook.

Data Processing: You grant Zhook a limited license to process, route, and store these payloads solely as necessary to provide the service (e.g., for HistoryBundles and Trigger Rules).

Compliance Storage: If your plan includes 2-year retention, Zhook acts as your Data Processor. You are responsible for ensuring the data you store complies with your local laws.

5. Pricing and Payments

Fees: Paid plans are billed in advance on a monthly or annual basis.

Changes: We may change our fees at any time, but we will provide at least 30 days' notice via email before any price increase takes effect.

Refunds: Unless required by law, all payments are non-refundable.

6. Intellectual Property

Ownership: Zhook, the Zhook logo, and our unique "HistoryBundle" architecture are our exclusive property.

Feedback: If you provide suggestions or feedback, we may use them without restriction or compensation to you.

7. Limitation of Liability

To the maximum extent permitted by law, Zhook’s total liability for any claim arising out of these terms is limited to the amount you paid us in the 12 months prior to the claim. We are not liable for any indirect, incidental, or consequential damages (including loss of data or profits).

8. Termination

We reserve the right to suspend or terminate your account if you violate these terms. Upon termination, your right to use the service ends immediately. You are responsible for exporting your data (via HistoryBundle) before your account is closed.

9. Governing Law

These terms are governed by the laws of Poland and the European Union, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Warsaw, Poland.

10. Data Protection

If you process personal data of individuals protected by the GDPR or other data protection laws through the Service, the parties agree to comply with the Zhook Data Processing Addendum (DPA) located at https://zhook.dev/dpa, which is hereby incorporated into these Terms by reference.
